NAR's Crack Down on Hate Speech

REALTORS® who engage in hate speech or discriminatory conduct even outside of their real estate practice could face disciplinary action under the Code of Ethics. The National Association of REALTORS®’ Board of Directors on Friday approved a proposal intended to hold members to a higher standard of ethics in everything they do. The board meeting was held during the virtual 2020 REALTORS® Conference & Expo. NAR President Vince Malta called the passage of the proposal “a monumental moment for NAR” in reaffirming its commitment to fair housing.

There has been a lot of buzz regarding NAR's new rule regarding Hate Speech and the chance of losing their license with their actions even on their "personal" time. Many believe this new standard is a violation of the First Amendment right to free speech. NAR is a private association that is supported by member dues so it has the ability to impose ethical duties to its membership.

The Board also approved a change to Policy Statement 29, Code of Ethics and Arbitration Manual. Revised Policy Statement 29 makes the Code of Ethics applicable to all of a REALTOR®’s activities, not just to real estate-related activities and transactions

Who Is Protected?

The Fair Housing Act prohibits discrimination in housing because of:

  • Race

  • Color

  • National Origin

  • Religion

  • Sex

  • Familial Status

  • Disability

  • Sexual orientation

  • Gender Identity

Why would NAR do this?

In my opinion, this new rule was to protect ALL of us! There has been so much distraction and ugliness on social media this past year. We have seen MANY social posts with people hating on other people and when they see they are a REALTOR® and with XXX Brokerage, what happens? That one person just represented that Brokerage, brand and profession altogether! I have seen this numerous times this year and apparently so have others so by adding these new Standards, it will protect our profession.

What does this mean for you?

Hopefully you are NOT one of those people posting hate speech and negativity all over social media. Does this new rule mean you can't have your own thoughts and opinions? Absolutely NOT. But you should never attack the above protected classes anyway so for the very LARGE majority, this new rule will not affect them at all but will protect us if someone does do something that could tarnish the real estate profession.
